The Supreme Court is happy to rubber stamp anything The Party wants to do, even if it diminishes the court's power.
And anyone in the military willing to oppose The Party and high enough up to make a difference has already been fired.
But The Party doesn't need to declare martial law. They already control all the wealth and industry, the Courts, the Executive, and the Pharisees. Taking more power would only solidify resistance and foment rebellion.
